Terms of Service

By accessing or using KitchenCountR — including the web app at kitchencountr.com and any related services (collectively, the "Service") — you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms are a binding legal agreement between you ("User," "you," or "your") and Polymath Impressions LLC ("KitchenCountR," "we," "us," or "our").

We may update these Terms at any time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Your continued use of the Service after any update constitutes acceptance of the revised Terms.

1. Eligibility

You must be at least 13 years of age to use KitchenCountR. Users between 13 and 17 must have parental or guardian consent. We do not knowingly collect personal information from children under 13; if you believe a child under 13 has registered, contact us at privacy@kitchencountr.com.

2. Accounts

Certain features require an account. You agree to provide accurate information and to safeguard your credentials; you are responsible for all activity under your account. Joining a live scoring session via 6-character code does not require an account, but guest users are still bound by these Terms. You may not create more than one personal account. We may suspend or terminate accounts for violations of these Terms. You may delete your account at any time in the app at Profile → Settings → Delete account (you will be asked to re-authenticate and confirm), or by emailing privacy@kitchencountr.com from the address on your account; deletion removes your personal data from our active systems shortly after, except as required for legal compliance or fraud prevention. Deleting your account does not automatically cancel a KC Pro subscription (billed via RevenueCat, processed through Stripe); cancel it first at Profile → Subscription to stop future charges.

3. KC Pro Subscription and Payments

KitchenCountR offers a premium subscription, KC Pro, at $39.99 per year. New subscribers may receive a 7-day free trial; if you do not cancel before the trial ends, your payment method will be charged the full annual fee. Subscriptions are billed annually and processed by RevenueCat with your chosen payment method. You may cancel anytime via Profile → Subscription → Cancel; cancellation takes effect at the end of the current billing period, and we do not offer prorated refunds for mid-period cancellations. We will provide at least 30 days' notice of any price increase. Business account tiers are subject to separate pricing and terms presented at enrollment, which may include subscription fees, commission on transactions, and fees for promoted placements.

4. KC Credits

KC Credits ("Credits") are a virtual loyalty reward for KC Pro members. Credits have no monetary value, cannot be redeemed for cash, and do not constitute property of any kind. Credits are non-transferable; you may not sell, trade, gift, or exchange them for any real-world value. Eligible KC Pro subscribers earn a small number of Credits for certain qualifying actions (currently scoring a match, court check-in, submitting a verified court, and referring a new user). Earning is rate-limited to prevent abuse — referral and verified-court rewards are capped per week, and scoring and check-ins are capped per day; actions beyond these limits do not earn Credits. Credits may be redeemed only for the limited in-app benefits made available in the Credits section (currently a tournament-entry discount and a booked-lesson discount), which have no cash value and are subject to change with reasonable notice. Credits expire after 24 months of account inactivity. KC Credits is a promotional program offered at our discretion; we may modify earning rates, qualifying actions, rate limits, redemption options, and expiration rules — or discontinue the program — with at least 30 days' notice for changes that materially reduce existing earned Credit value, and earning stops if your KC Pro subscription ends. You may not earn Credits through fraudulent, automated, or manipulative means; we may withhold or reverse Credits and suspend accounts that do. All Credits are forfeited upon account termination, with no compensation.

4a. Advertising (Free Tier)

The free tier of the Service is supported in part by advertising; free-tier users may see ads in the app, and KC Pro subscribers do not. Ads are contextual and non-personalized — we do not use your personal information to target ads or sell your personal information. We are not responsible for third-party products or services advertised in the app.

5. User-Generated Content

The Service allows you to submit posts, photos, videos, comments, court information, profiles, and match data ("User Content"). You retain ownership of your User Content. By submitting it, you grant KitchenCountR a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, host, store, reproduce, modify, distribute, display, and create derivative works from it, solely to operate, maintain, and improve the Service. This license ends when you delete your content or close your account, subject to content already shared with others.

Content standards

You may not post User Content that is false, misleading, defamatory, harassing, abusive, or threatening; infringes intellectual property rights; contains nudity, pornography, or graphic violence; exploits or endangers minors; promotes illegal activities, discrimination, or hate; contains spam or unsolicited advertising; reveals another person's private information without consent; or impersonates any person or entity.

Court submissions & moderation

Courts submitted by users are reviewed before being added to the database; submission does not guarantee inclusion. We may remove any User Content that violates these Terms, without prior notice, and we maintain a reporting and progressive-sanction system. We are not obligated to pre-screen content.

DMCA / Copyright

If you believe your copyrighted work has been posted without authorization, contact us at legal@kitchencountr.com with: identification of the work; identification of the infringing material and its location; your contact information; a good-faith statement; and a statement under penalty of perjury that the information is accurate and you are the rights holder or authorized to act.

6. Community Standards

By using community features, you agree to treat all players with respect, keep competition friendly and sportsmanlike, report violations using the in-app report function, not organize or promote illegal activity, and not impersonate other users, coaches, or public figures. Violations may result in restriction or termination of community features depending on severity.

7. Business Accounts

Business Accounts are available to licensed coaches, legitimate retail businesses, and event organizers; we may verify eligibility and deny or revoke Business Account status at our discretion. Business Account holders are solely responsible for the accuracy of their profile information. Promoted placement may be purchased and must comply with content standards and be clearly labeled as promoted. Transactions processed through the Platform (such as lesson bookings) may be subject to a commission fee disclosed at enrollment. Business Account enrollment is governed by a separate Business Account Agreement, which controls in the event of conflict with these Terms.

8. Intellectual Property

The KitchenCountR name, logo, app, design system, and all proprietary content are owned by Polymath Impressions LLC and protected by intellectual property law. You may not copy, modify, distribute, reverse engineer, or create derivative works from our IP without written permission. Any feedback, ideas, or suggestions you submit become our property, usable without restriction, attribution, or compensation.

9. Privacy & Third-Party Services

Your use of the Service is governed by our Privacy Policy, incorporated into these Terms by reference. The Service integrates with third-party providers including Firebase (Google), RevenueCat, and YouTube, whose own terms and privacy policies govern your use of them. We are not responsible for the practices of any third-party service.

10. Push Notifications

If you opt in to push notifications, we may send messages related to your matches, community activity, and Service updates. You may opt out at any time via Profile → Notification Settings or your device settings. Opting out does not affect your account.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that match scores, court information, or user content are accurate or complete, or that the Service will meet your requirements.

12. Limitation of Liability

To the maximum extent permitted by law, KitchenCountR and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total aggregate liability shall not exceed the greater of (a) the fees you paid us in the 12 months preceding the claim, or (b) $50 USD. Some jurisdictions do not allow these limitations, so they may not fully apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless KitchenCountR and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, your violation of these Terms, or your violation of any third party's rights.

14. Dispute Resolution

Before filing any formal legal claim, you agree to contact us at legal@kitchencountr.com and attempt to resolve the dispute in good faith for at least 30 days. If informal resolution fails, any dispute shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in [County, State] or virtually if both parties agree.

Class Action Waiver: You and KitchenCountR agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class or representative action.

Either party may seek injunctive or equitable relief in court to prevent irreparable harm without waiving the right to arbitrate other claims. These Terms are governed by the laws of the State of [State], without regard to conflict-of-law provisions.

15. Changes, Termination & General

We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice of material changes. We may suspend or terminate access for conduct that violates these Terms or is harmful to others. Provisions that by their nature survive termination (IP, liability, indemnification, dispute resolution) remain in effect. These Terms, the Privacy Policy, and any feature-specific terms are the entire agreement between you and KitchenCountR. If any provision is unenforceable, the rest remain in force. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them to a successor. These Terms confer no third-party beneficiary rights. We are not liable for delays caused by events outside our reasonable control.
